By accessing the Site, purchasing, downloading, activating, installing, or using any of our Expert Advisors, software, presets, guides, or related materials collectively, the “Software”, you agree to be bound by these Terms & Conditions.

If you do not agree to these Terms, you must not use the Site or the Software.

 

Risk Warning and No Investment Advice

Trading foreign exchange, CFDs, and other leveraged financial instruments carries a high level of risk and may not be suitable for all investors. You may lose some or all of your capital.

Past performance, including any backtests, forward tests, simulated results, or live results shown on the Site or through third-party services, is not a guarantee of future performance.

All content on the Site and all Software are provided for informational and educational purposes only. Nothing on the Site or in the Software constitutes financial advice, investment advice, legal advice, tax advice, brokerage advice, or a recommendation to buy, sell, or hold any financial instrument.

Any reference to a broker, preferred broker, partner broker, account type, platform, or trading environment is provided for operational, compatibility, onboarding, or commercial purposes only and must not be interpreted as regulated financial advice or a personal recommendation.

You remain solely responsible for:

  • your trading decisions,
  • your broker selection,
  • your risk settings,
  • your account configuration, and
  • any profits or losses arising from your trading activity.

 

Eligibility and User Responsibilities

By using the Site or purchasing the Software, you confirm that:

  • you are at least 18 years of age,
  • you have the legal capacity to enter into a binding agreement,
  • your use of the Site and Software is lawful in your jurisdiction, and
  • you are authorised to use the payment method and trading account details you provide.

You are responsible for ensuring that your:

  • MetaTrader platform version,
  • broker,
  • VPS,
  • device,
  • operating environment,
  • internet connection, and
  • local laws and regulations

are suitable and lawful for use with the Software.

You agree to test the Software in MetaTrader Strategy Tester and on a demo account before using it on any live account. You acknowledge that broker execution, spreads, slippage, commissions, market conditions, latency, and broker-specific trading rules may materially affect results.

 

Products, Digital Delivery, and Availability

Our products are digital software products and related digital content, including but not limited to:

  • MetaTrader 4 Expert Advisors,
  • presets,
  • installation guides,
  • onboarding materials, and
  • related documentation.

The specific features, platform compatibility, broker requirements, preferred broker conditions, and license scope of each product are described on the relevant product page, checkout page, onboarding material, or written communication from us.

Following successful payment, delivery is made digitally by email, download link, user account access, or another delivery method stated on the Site.

While delivery is usually immediate, in some cases it may take up to 48 hours, including where fraud checks, payment verification, broker verification, affiliate tracking confirmation, or manual review are required.

We reserve the right to:

  • modify, suspend, or discontinue any product,
  • correct pricing or content errors,
  • restrict access where misuse, fraud, or abuse is suspected,
  • refuse any order at our discretion before delivery.

 

Preferred Broker Requirement and Own Broker Activation Fee

Certain Software prices, packages, discounts, bonuses, onboarding support, and license terms may be based on the client signing up for and using the Software with one of our preferred brokers.

A “Preferred Broker” means a broker listed by us on the Site, during checkout, in onboarding materials, or in direct written communication as a preferred, approved, supported, partner, or recommended broker for use with the Software.

Where a product, offer, discount, package, or license is provided on the basis that the client signs up under one of our Preferred Brokers, the client must complete the broker signup using our approved referral, affiliate, partner, or tracking link where required.

We may receive an affiliate commission, referral commission, rebate, or other commercial benefit if you sign up with or trade through a Preferred Broker. This does not change your responsibility to decide whether that broker is suitable for you.

If you do not sign up under one of our Preferred Brokers, cannot provide reasonable evidence that your broker account was opened through our approved broker link where required, or you choose to use your own broker instead of a Preferred Broker, an additional Own Broker Activation Fee of $499.95 will apply.

This Own Broker Activation Fee may apply where you request, require, or use the Software with:

  • your own existing broker,
  • a broker account not opened through our approved referral or affiliate link,
  • a broker not listed as a Preferred Broker,
  • a broker server that has not been pre-approved by us,
  • a different broker after initial activation, or
  • any broker environment requiring additional activation, verification, configuration, support, or compatibility review.

The Own Broker Activation Fee is charged in addition to the Software purchase price unless expressly waived by us in writing.

Payment of the Own Broker Activation Fee does not guarantee:

  • profitability,
  • trading performance,
  • broker suitability,
  • broker execution quality,
  • spread quality,
  • low slippage,
  • compatibility with all settings,
  • continued broker support,
  • or that the Software will perform in the same way as it may perform with a Preferred Broker.

We may decline activation or support for a non-preferred broker if, in our reasonable opinion, that broker’s trading conditions, platform setup, account type, execution model, symbols, contract specifications, leverage, spreads, slippage, restrictions, or technical environment are unsuitable for the Software.

If we decline a non-preferred broker before carrying out activation, configuration, support, or compatibility work, we may refund the Own Broker Activation Fee only. This does not automatically entitle you to a refund of the Software purchase price unless required by law or otherwise stated in these Terms.

 

License Grant and Activation

Subject to these Terms and successful payment, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Software strictly in accordance with:

  • the product page description,
  • your purchased license type,
  • any broker-related conditions,
  • any Preferred Broker or Own Broker Activation Fee requirements, and
  • these Terms.

Licenses are provided as one-time purchases, unless expressly stated otherwise on the product page.

Your license may be restricted by factors such as:

  • number of live accounts,
  • specific account numbers,
  • demo/live distinction,
  • platform type,
  • broker,
  • broker server,
  • Preferred Broker status,
  • Own Broker Activation Fee payment status,
  • server or broker environment.

Activation may require a license key and/or submission of information such as:

  • MT4/MT5 account number,
  • broker name,
  • broker server,
  • account type,
  • proof of broker signup where relevant,
  • activation logs,
  • device or platform identifiers.

We may use this information to administer licenses, verify broker eligibility, provide support, apply broker-related license conditions, and prevent abuse.

If your license or product package requires Preferred Broker signup and we cannot verify that your trading account was opened under our approved broker link, we may refuse activation until either:

  • the Preferred Broker requirement is satisfied, or
  • the Own Broker Activation Fee of $499.95 is paid.

You must not:

  • share,
  • resell,
  • sublicense,
  • distribute,
  • copy to unauthorised live accounts,
  • use on unauthorised broker accounts,
  • reverse engineer,
  • decompile,
  • modify for resale,
  • leak,
  • disclose, or
  • transfer

the Software, presets, documentation, license keys, or protected materials without our prior written consent.

If we reasonably believe that a license has been copied, shared, abused, used outside its permitted scope, used on an unauthorised broker, or used without payment of any applicable Own Broker Activation Fee, we may suspend or terminate the license immediately and without refund.

 

Use of Presets, Settings, and Risk Controls

We may provide presets or suggested settings, including examples such as:

  • Conservative,
  • Moderate,
  • Aggressive,
  • position sizing profiles,
  • equity protection settings,
  • take-profit or stop-loss frameworks.

These are provided for convenience only and do not guarantee performance or suitability for your account.

You are solely responsible for:

  • the settings you apply,
  • any modifications you make,
  • your lot size,
  • your exposure,
  • your account leverage,
  • your broker choice, and
  • the trading conditions under which you deploy the Software.

Using settings outside our published guidance, using unsupported account types, or using a non-preferred broker may materially increase the risk of loss. You accept full responsibility for any configuration, broker, account type, or trading environment you choose to use.

 

Refund Policy and Digital Content

6.1 30-Day Refund Policy for Unused Licenses Only

We offer a 30-day refund policy for unused licenses only.

For the purpose of this policy, a license will be considered unused only if:

  • it has not been activated on any live or demo account,
  • it has not connected to our licensing or activation system,
  • the Software has not been used in a live account, demo account, or strategy tester, and
  • downloadable materials have not been materially accessed or used beyond initial receipt.

We may verify usage status through activation logs, download records, account associations, broker records, support records, or other reasonable technical records.

If the Software has been activated, installed, tested, or used in any material way, it will be considered used and will not be eligible for refund.

Where an Own Broker Activation Fee has been paid, that fee will generally be non-refundable once we have begun activation, broker review, compatibility assessment, licensing work, configuration support, or related onboarding assistance.

6.2 UK / EU Digital Content Notice

If you are a consumer in the UK or EU, you may have statutory rights relating to distance purchases and digital content.

Where permitted by law, if you request or consent to immediate access, download, or supply of digital content before the end of any cooling-off period, you acknowledge that your cancellation right may be reduced or lost once supply begins.

By downloading, activating, accessing, or using the Software or related digital content, you expressly request immediate digital supply and acknowledge that your cancellation rights may be waived to the extent permitted by applicable law.

6.3 Refund Request Procedure

To request a refund for an unused license within 30 days, contact:

Please include:

  • your order ID,
  • your purchase email address,
  • your full name, and
  • a brief explanation of the request.

Where permitted by law, refunds may exclude:

  • non-recoverable payment processor fees,
  • bank charges,
  • wire fees,
  • currency conversion losses,
  • third-party transaction costs.

If a chargeback is filed without first contacting us and giving us a reasonable opportunity to assist, we reserve the right to treat that as potential license abuse and terminate any associated licenses or accounts.

 

No Guarantee of Performance and No Liability for Trading Losses

You acknowledge and agree that:

  • markets can move rapidly and unpredictably,
  • spreads, slippage, gaps, news events, platform outages, broker restrictions, VPS issues, or connectivity failures may affect results,
  • the Software may not perform the same way across different brokers or market environments,
  • Preferred Broker use does not guarantee profits,
  • Own Broker use may produce materially different results,
  • no software can eliminate trading risk.

To the maximum extent permitted by law, Nexus Forex Trading is not responsible for:

  • trading losses,
  • opportunity losses,
  • loss of profits,
  • indirect losses,
  • broker losses,
  • account closure,
  • missed trades,
  • delayed trades,
  • execution errors caused by third parties,
  • data loss,
  • infrastructure failure.

You remain solely responsible for how the Software is configured and deployed.

 

Compatibility and Third-Party Services

The Software may rely on third-party services, products, or infrastructure, including but not limited to:

  • MetaTrader,
  • brokers,
  • VPS providers,
  • payment processors,
  • email providers,
  • Myfxbook,
  • FX Blue,
  • other analytics or verification tools.

We do not own or control those third-party services and do not guarantee:

  • their availability,
  • uptime,
  • compatibility,
  • pricing,
  • security,
  • continued support,
  • execution quality,
  • spreads,
  • slippage,
  • commissions,
  • platform stability,
  • or performance.

Different brokers may use different symbol names, contract sizes, spreads, execution models, trading restrictions, margin rules, leverage rules, server settings, and platform conditions. These differences may affect whether the Software can operate correctly or profitably.

We are not liable for issues caused by third-party platforms, services, brokers, data feeds, provider changes, or account conditions.

 

Support

We provide reasonable email support for:

  • installation,
  • activation,
  • delivery issues,
  • basic usage guidance,
  • licensing questions.

Support is provided during our normal business hours as stated on the Site, if any.

Unless expressly stated otherwise, support does not include:

  • custom development,
  • bespoke coding,
  • broker-specific optimisation,
  • account management,
  • investment advice,
  • broker advice,
  • profitability coaching,
  • individual strategy redesign,
  • advanced MQL programming help.

Support for a non-preferred broker may be limited and may require payment of the Own Broker Activation Fee of $499.95 before we provide activation, compatibility review, broker-specific setup guidance, or related assistance.

We may update, limit, or discontinue support channels at our discretion.

 

Intellectual Property Rights

All intellectual property rights in the Site and Software, including but not limited to:

  • code,
  • algorithms,
  • presets,
  • guides,
  • branding,
  • logos,
  • graphics,
  • written content,
  • videos,
  • downloads,
  • product packaging,
  • and documentation

are owned by or licensed to Nexus Forex Trading and protected by copyright, trademark, and other applicable intellectual property laws.

No ownership rights are transferred to you. You are granted only the limited license expressly described in these Terms.

 

Prohibited Conduct

You agree not to:

  • circumvent or attempt to circumvent license controls,
  • share or resell the Software or license keys,
  • use the Software unlawfully,
  • use the Software in violation of broker rules or platform rules,
  • use the Software on an unauthorised broker account,
  • avoid or bypass any applicable Preferred Broker or Own Broker Activation Fee condition,
  • misrepresent broker signup status,
  • misrepresent performance using our brand,
  • publish false or misleading claims about our products,
  • scrape protected content or restricted data,
  • interfere with the Site, servers, payment systems, or licensing systems,
  • upload malware or harmful code,
  • impersonate Nexus Forex Trading or its affiliates.

We may suspend or terminate access or licenses where prohibited conduct is suspected.

 

Disclaimer of Warranties and Limitation of Liability

To the maximum extent permitted by law:

The Site and Software are provided on an “as is” and “as available” basis.

We disclaim all warranties, whether express or implied, including but not limited to:

  • merchantability,
  • fitness for a particular purpose,
  • non-infringement,
  • uninterrupted availability,
  • broker compatibility,
  • platform compatibility,
  • or accuracy of third-party data.

We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including:

  • lost profits,
  • trading losses,
  • business interruption,
  • reputational loss,
  • data loss,
  • or loss of opportunity,

even if we were advised such damages were possible.

Our total aggregate liability arising from or related to the Site, Software, Own Broker Activation Fee, broker compatibility review, or these Terms shall not exceed the total amount actually paid by you for the specific license or product giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including for fraud or any other liability that applicable law does not permit us to limit.

 

Indemnity

You agree to indemnify, defend, and hold harmless Nexus Forex Trading, its owners, affiliates, officers, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • your misuse of the Site or Software,
  • your breach of these Terms,
  • your trading activity,
  • your broker selection,
  • your use of a non-preferred broker,
  • your failure to pay any applicable Own Broker Activation Fee,
  • your violation of law,
  • your infringement of third-party rights.

 

Privacy and Cookies

Your use of the Site and Software is also subject to our:

  • Privacy Policy
  • Cookie Policy

These explain how we collect, use, and process personal data, analytics data, support records, broker information, and licensing information.

By using the Site or Software, you acknowledge that your personal data may be processed in accordance with those policies.

 

Pricing, Taxes, Broker Conditions, and Payments

Prices are shown on the Site and may be changed at any time before purchase.

Some prices, discounts, offers, bonuses, or packages may be conditional on signing up under one of our Preferred Brokers using our approved broker link.

If you choose not to sign up under a Preferred Broker, cannot verify eligible Preferred Broker signup, or choose to use your own broker, the additional Own Broker Activation Fee of $499.95 will apply unless expressly waived by us in writing.

Applicable taxes, VAT, sales tax, or similar charges may be added depending on your location and legal requirements.

Payments are processed through third-party payment providers. We do not store full payment card details unless expressly stated and lawfully required.

You are responsible for providing accurate billing information and for any fees charged by your bank, card issuer, or payment provider.

 

Site Changes, Availability, and Force Majeure

We may modify or update the Site, Software, documentation, presets, broker lists, Preferred Broker arrangements, pricing, or product offerings at any time without notice.

We do not guarantee that the Site or Software will be available without interruption or error.

We are not responsible for any delay, interruption, or failure caused by events outside our reasonable control, including but not limited to:

  • internet outages,
  • hosting failures,
  • power failures,
  • cyberattacks,
  • platform outages,
  • broker outages,
  • government actions,
  • war,
  • natural disasters,
  • labor disputes,
  • payment processor failures.

 

External Links and Third-Party Content

The Site may contain links to third-party websites, dashboards, brokers, platforms, tools, or resources for convenience only.

We do not control and are not responsible for:

  • their content,
  • terms,
  • privacy practices,
  • availability,
  • pricing,
  • account approval,
  • trading conditions,
  • or accuracy.

Accessing third-party services is at your own risk.

 

Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to them shall be governed by the laws of England and Wales, without regard to conflict of law principles.

The courts of England and Wales shall have exclusive jurisdiction, except where mandatory consumer protection laws in your place of residence provide otherwise.

 

Severability and Entire Agreement

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, Cookie Policy, refund rules, broker-related conditions, Preferred Broker requirements, Own Broker Activation Fee terms, and any order confirmation, constitute the entire agreement between you and us in relation to the Site and Software and supersede any prior discussions or understandings on that subject.

 

Changes to These Terms

We may update these Terms from time to time.

When we do, we will update the Effective Date or Last Updated date at the top of this page. Material changes may also be posted on the Site or communicated by email where appropriate.

Your continued use of the Site or Software after any update constitutes acceptance of the revised Terms.
